Broad Oak Pre-School Privacy Notice.
Introduction:
We are fully committed to ensuring that the personal data we hold about you and your child/ren is protected in accordance with the data protection laws and is used in line with your expectations.
Our privacy notices explains what data we collect, why we collect it, how it's used, including how it's stored and the steps we take to protect your data.
What personal data do we collect?
We collect personal data about you and your child/ren to provide childcare based on our working practice of caring for children in the setting. We also collect data to verify your eligibility for free childcare where applicable.
Data we collect about your child/ren includes?
- your child/rens name, date of birth, address, health & medical needs, development needs, and any special educational needs.
Where applicable we obtain child protection plans from social care & health care plans from health professionals.
We will also request information about parental responsibility for your child/ren and any court orders pertaining to your child/ren.
Personal details that we collect about you include:
- your name, address (work & home), relevant contact numbers, email address, emergency contact details, and family details.
This information is collected on our registration form for the setting.
If you apply for up to 30 hours free childcare, we will also collect:
- your national insurance numbers or unique taxpayer reference (UTR). Information on any benefits that you may receive.
Why we collect this information and the legal basis for handling your data.
We use personal data about you and your child/ren in order to provide childcare services and fulfill the contractual arrangement you have with the setting. This includes using your data to:
- contact you in case of an emergency
- to support your child's well-being and development
- to manage any special educational, health or medical needs of your child whilst at the setting
- to carry out a regular assessment of your child/rens progress
- to identify any areas of concern
- to maintain contact with you and respond to any questions you may have
- to keep you up to date with additional marketing or fundraising activities taking place
- to process any claims you may have for funding or free childcare
- to keep you updated with all aspects of our service
With your consent, we will also record your child's activities for their individual learning journey. This may include photographs and video recordings. You have the right to withdraw your consent at any time. Please contact the setting manager.
We have a legal obligation to process safeguarding related data about your child should we have any concerns about their welfare. We also have a legal obligation to transfer records and certain information about your child/ren to the school that your child/ren will be attending.
Who we share your data with.
So that we can deliver childcare services we also share your data as required with the following stakeholders:
- Ofsted
- The local authority
- Our insurance underwriter (where relevant)
- The school your child/ren will be attending
We will also share your data if:
- We are legally required to do so, for example, by law or court order
- To enforce the terms and conditions of your contract with us
- To protect your child/ren and other children; for example sharing information with social services or the police
- It is necessary to protect our rights, property or safety
We will never share your data with other organisations to use for their own purposes.
How do we protect your data?
We protect unauthorised access to your personal data and prevent it from being lost, accidentally destroyed, misused or disclosed by:
- password protected PC/laptop, encrypted devices, locked cupboards, locked filing cabinets.
How long do we retain your data?
We retain your child's personal data for up to 3 years after your child no longer uses our setting, or until our next Ofsted inspection after your child leaves our setting. Medication, accident and safeguarding records are kept for longer periods in line and according to legal requirements. Your personal learning journey is handed to you on your child/ren leaving the setting.
Your rights with respect to your data.
You have the right to:
- request access, amend or correct your/your child/ren's personal data
- request that we delete or stop processing your/your child/ren's personal data, for example where the data is no longer necessary for the purposes of processing; and request that we transfer your and your child/ren's personal data to another person

Changes to this notice. The privacy notice is reviewed annually along with all other policies adopted by Broad Oak Preschool.
